1. Platform Role

SayWill.com is an online community marketplace that connects neighbors for the purpose of buying, selling, exchanging goods and providing services. The platform functions solely as an information- and communication-facilitator, and does not act as a seller, service provider, insurer, guarantor, or agent for any user transaction.

2. No Verification of Users, Listings or Services

  • We do not verify the identity, credentials, qualifications, licensure, insurance, or background of any seller, service provider, buyer, or user.
  • We do not inspect, test, certify or guarantee the description, condition, authenticity, legality, safety or fitness for purpose of any item or service listed on the platform.
  • All items are listed by users and all services are provided by users. We rely on those users to be truthful and accurate; however, we make no representations or warranties regarding accuracy, completeness or reliability of any listing, user statement or service description.

3. “As-Is” Sales and User-to-User Services

  • Any goods offered on the platform are to be considered sold “ as is” by the seller—whether new, used or “pre-owned”. You, as a buyer, accept the item in the condition presented at the time of sale and assume all risk thereafter.
  • Services arranged on the platform are provided by independent users, not by SayWill. You engage with service providers at your own risk and agree that SayWill is not responsible for the performance, quality, outcome, safety or legal compliance of any service.

4. No Guarantee of Accuracy or Availability

  • We do not guarantee that listings will remain available, or that descriptions, prices, images, or any information will be accurate, complete or up to date.
  • We do not guarantee delivery times, availability of pickup windows, or service scheduling; those are subject to user availability, community logistics, and other factors beyond our control.
  • Any reliance you place on information on the platform is strictly at your own risk.

5. Limitation of Liability

To the fullest extent permitted by applicable law, SayWill and its affiliates, officers, directors, employees, agents and licensors shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages (including but not limited to: loss of profits, use, goodwill, data or other intangible losses) arising out of or in connection with:

  • your access to, use of, or inability to use the platform;
  • any transaction, listing, service, delivery, pickup or meeting between users;
  • any error, omission, misrepresentation or negligence of any user;
  • any delay, failure, interruption or other problem in delivery, service provision or user-to-user interaction.

6. User Responsibility and Due Diligence

  • You must inspect items and ask questions of sellers; you should verify service provider credentials if relevant to your needs.
  • You should use safe practices when meeting in person, making payments, arranging pickups or acceptances, deliveries or services.
  • You are responsible for checking local, state and federal laws that may apply to your transaction (for example taxation, licensing, resale, service permitting).
  • You assume full responsibility for the outcome of any transaction or service you enter into via the platform.

7. Links and Third-Party Content

The platform may contain links to third-party websites or resources. SayWill does not endorse, guarantee, or accept responsibility for the accuracy or reliability of any third-party content. Your use of third-party links is at your own risk.

8. Jurisdiction and Applicable Law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws provisions. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas, for any dispute arising out of or relating to this Disclaimer or your use of the platform.

9. Changes to Disclaimer

We may update this Disclaimer at any time. The “Effective Date” above indicates when the current version is in force. Continued use of the platform after such changes constitutes your acceptance of the revised Disclaimer. Please check this page periodically.
